The Rights to Institution an Administrative Case of a Career Groups in Mahasarakarm Province

Abstract

This research aims to study the right to file an administrative lawsuit by groups of individuals organized as occupational groups. The study focuses on four main objectives: 1) To examine the concepts and legal principles related to the right of such groups to initiate administrative lawsuits; 2) To study the precedents and practical approaches in determining this right within Maha Sarakham Province; 3) To analyze the challenges and obstacles faced by occupational groups in Maha Sarakham in accessing this legal right; and 4) To develop policy proposals and practical guidelines to promote the exercise of such rights and ensure equitable access to administrative justice.

This research adopts a qualitative methodology, utilizing descriptive analysis based on legal documents, court rulings, and case studies from Maha Sarakham Province.

The findings reveal that, although the Constitution of the Kingdom of Thailand and the Act on Establishment of Administrative Courts and Administrative Court Procedure B.E. 2542 (1999) recognize the right to file administrative lawsuits for those suffering damages caused by acts or omissions of administrative agencies or officials, the interpretation of “groups of individuals,” particularly occupational groups not yet established as legal entities, remains ambiguous in practice. While some court rulings allow representatives to act on behalf of such groups under certain conditions, structural problems, legal limitations, lack of awareness, and insufficient legal support mechanisms remain significant barriers at the local level. Based on these findings, the study proposes that relevant legal provisions be amended, and that policy measures and practical mechanisms be implemented to enable occupational groups to effectively and equitably access the administrative justice system.
