บทคัดย่อ

บทความวิชาการนี้มีวัตถุประสงค์เพื่อศึกษาสิทธิในการรักษาพยาบาลของข้าราชการและสิทธิในการรักษาพยาบาลของประชาชนทั่วไปในประเทศไทย โดยเฉพาะการวิเคราะห์ความเหลื่อมล้ำในสิทธิการรักษาพยาบาลที่เกิดจากความแตกต่างในระบบสาธารณสุข ซึ่งได้แก่ ระบบสวัสดิการรักษาพยาบาลข้าราชการ ระบบประกันสังคม และระบบหลักประกันสุขภาพแห่งชาติ ที่มีลักษณะการให้สิทธิประโยชน์และหลักเกณฑ์ในการเข้าถึงบริการที่แตกต่างกัน ระบบเหล่านี้มีวัตถุประสงค์ที่ต่างกันและได้รับการจัดสรรงบประมาณในระดับที่ไม่เท่ากัน ส่งผลให้เกิดความเหลื่อมล้ำในด้านการบริการ สิทธิประโยชน์ และการเข้าถึงการรักษาพยาบาล ทั้งในแง่ของงบประมาณที่ได้รับ และประเภทของบริการที่ประชาชนแต่ละกลุ่มได้รับ ในบทความนี้จะพิจารณาขอบเขตการศึกษาในแง่ของการเปรียบเทียบการใช้สิทธิในแต่ละระบบและการวิเคราะห์ว่าความเหลื่อมล้ำที่เกิดขึ้นนั้นขัดต่อหลักความเสมอภาคภายใต้รัฐธรรมนูญหรือไม่ พร้อมทั้งเสนอแนวทางในการแก้ไขปัญหาความเหลื่อมล้ำเพื่อสร้างความเท่าเทียมในการให้บริการสุขภาพแก่ประชาชนทุกคนอย่างเสมอภาคและไม่เลือกปฏิบัติ
